TERMS OF SERVICE

1. Eligibility

You must be at least 18 years old or have authorization from your employer or organization to use our Services.

If your employer creates an account for you, your employer may control certain aspects of your account, including course assignments and reporting.

 

2. Use of Our Services

You agree to use the Services only for lawful business and educational purposes.

You agree not to:

  • Copy, reproduce, or redistribute course content without written permission
  • Attempt to gain unauthorized access to our systems
  • Upload malicious software or interfere with the operation of the Services
  • Reverse engineer or modify our software

Violation of these terms may result in suspension or termination of your account.

 

3. Intellectual Property

 

All training materials, videos, graphics, documents, quizzes, job aids, software, branding, logos, and website content are owned by FSGenius or licensed to us.

Completion of training does not grant ownership or redistribution rights.

You may not reproduce or distribute our content without written permission.

 

4. User Accounts

Users are responsible for maintaining the confidentiality of their passwords.

You agree to notify us immediately if you believe your account has been compromised.

We reserve the right to suspend accounts used fraudulently or in violation of these Terms.

 

5. Customer Content

Organizations using FSGenius may upload:

  • Training materials
  • Documents
  • Videos
  • Images
  • Standard operating procedures
  • Job aids
  • Other educational content

Customers retain ownership of their uploaded content.

By uploading content, you grant FSGenius permission to host, store, display, and distribute that content only as necessary to provide the Services.

 

6. Training Records

Our platform may record:

  • Course enrollments
  • Course completions
  • Quiz scores
  • Certificates
  • Training progress
  • Login activity

 

 Usage analytics

These records are provided to authorized administrators within your organization.

 

7. Availability

We strive to maintain reliable service but cannot guarantee uninterrupted availability.

Maintenance, updates, internet outages, or circumstances beyond our control may temporarily interrupt service.

 

8. Third-Party Services

Our website and learning platform may integrate with third-party services, including:

  • Learning Management Systems
  • Authentication providers
  • Video hosting platforms
  • Email services
  • Analytics providers

Those services operate under their own privacy policies.

 

9. Limitation of Liability

To the fullest extent permitted by law, FSGenius shall not be liable for indirect,  incidental, special, consequential, or punitive damages arising from the use of our Services.

Training materials are provided for educational purposes and do not replace manufacturer instructions, safety procedures, regulatory requirements, or professional judgment.

 

10. Disclaimer

The Services are provided “as is” without warranties of any kind.

We make reasonable efforts to ensure training materials are accurate but cannot guarantee that all content remains current or error-free.

 

11. Termination

We reserve the right to suspend or terminate access for users who violate these Terms.

Organizations may terminate their subscriptions according to their service agreement.

 

12. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, unless mandatory laws of another jurisdiction require otherwise.

Any disputes shall be resolved in the appropriate courts of Ohio unless otherwise required by applicable law.
